Sector-level bargaining and possibilities for deviations at company level: Austria

The legal basis of collective bargaining in Austria is laid down by the LabourConstitution Act (ArbVG). According to the ArbVG, collective agreements can beconcluded only between collective organisations of employers and employees.Therefore, the Austrian labour law systematically benefits multi-employer bargaining. Consequently, the overwhelming majority of collective agreementsare concluded at sectoral level. Collective bargaining is generally restrictedto the private sector. In the public sector, wages and working conditions are –in formal terms – unilaterally determined by the public authorities, but are actually negotiated in informal talks with the public sector unions.
