The essay focuses on the organizational and direct participation, on the one hand, and indirect or representative participation, on the other, highlighting how the former is increasingly gaining the upper hand in legal discourse and projects for regulation on employee involvement and participation. In the final part of the essay the A. highlights the opportunity for indirect or representative forms of participation to still be supported by auxiliary regulation, especially where the use of new digital technologies and applications risks compromising the fundamental rights of workers.
