The paper comments on sentence no. 194 of 2018 of the Constitutional Court on the new legislation on individual dismissal. The author discusses the Court's decision on discrimination between workers, which derives from the contested provision. In the second part of the essay the author evaluates the recognition of the European Social Charter and the declaration of constitutional illegitimacy of the d. lgs. n. 23/2015, in relation to the measure of compensation.
