La riforma della rappresentanza aziendale dei lavoratori. Dal sistema duale al doppio canale: itinerari possibili

Il presente scritto è destinato agli Studi in onore di Raffaele De Luca Tamajo.

Mentre il lavoro era già in fase di pubblicazione le Confederazioni sindacali dei lavoratori hanno approvato il documento unitario “Un moderno sistema di relazioni industriali. Per un modello di sviluppo fondato sull’innovazione e la qualità del lavoro” (Cgil, Cisl e Uil, 14 gennaio 2016). Il documento avvalora una delle idee centrali di questo scritto, proponendo una riconversione del sistema di relazioni industriali e delle regole che ne governano il funzionamento basata sul coordinamento dei temi della rappresentanza, della contrattazione di secondo livello, della partecipazione dei lavoratori nelle imprese.

The paper offers a broad analysis of the draft laws presented in the last three years in the field of trade union representation and focuses on Italian system for employee representation at the workplace. Starting from the Consolidated Text on Union’s Representation signed by Confindustria and CGIL, CISL and UIL on 10 January 2014 (“Testo Unico sulla Rappresentanza”), the A. analyzes the anomaly of the Italian dual system confronted with systems dual channel present in other Eu countries (France, Spain, Germany, Netherlands). The Italian anomaly is due to the lack of a separation of funcions between RSA and RSU and the absence of a legal framework of employee participation in the workplace. The last part of the paper focuses on the guidelines for a reform which provides a separation of funcions between RSA and RSU, conferring participation rights to elected representatives and bargaining power to trade union representation.
