First, the essay draws the statutory framework before the reform of employment sport’s law. In particular, such analysis starts from law no. 91/1981, which sets forth the professional sport’s discipline, whereas the “amateurism sport” has been regulated only as regards the social security and tax grounds. Then, the article takes into consideration legislative decree no. 36/2021 in order to assess its points of continuity and discontinuity with regard to the previous legislation. Further, it deals with the interweaving between the reform of employment sport’s law and the amendments concerning the “third sector” since “amateurism sport” can be practiced by both organizations belonging to “third sector” and “social enterprises”. In particular, the essay enquires, on the one hand, the relationship between the notion and discipline of “amateur sportsmen” in comparison with volunteering in the “third sector”, and, on the other hand, the new legislation concerning the sports organizations’ administrative collaborators. Indeed such new legislation, once it will enter into force, leads to the complete application of employment law together with its well-known qualification and regulation issues.
