The essay situates Law No. 76/2025 on the employee participation in corporate management within the constitutional framework, “taking seriously” the programmatic wording of the law itself, which aims to give effect to Article 46 of the Constitution. After briefly analyzing the various interpretations of the constitutional provision that have emerged over the decades, it adopts the one considered most plausible and robust. Noting several problematic aspects regarding this interpretation in Law No. 76/2025, the essay proposes a constitutionally oriented interpretation capable also of strengthening its effectiveness beyond its nature as an “apparent law.”
