The essay aims to frame the new organization of the labor market described by Legislative Decree no. 150/2015, with particular reference to the relationship between levels of government and the role reserved for private parties. The National Agency for the active labor market policies (ANPAL) upsets the pre-existing organizational structure, shifting the center axis of the labor market governance by individual regions to the central government. Even the skills of regulators sources undergo flexible approach effect inaugurated by the reform. It revitalizes the role of the state beyond the powers provided by the current Constitution. This depends on the recent development of the method of the agreements between the State and regional and local authorities, whose strength and tightness accredit conventional source as a tool able to introduce corrections to the rigid constitutional allotment. It is no coincidence that new corrections to the Constitution approved definitively April 12, 2016 to identify the institution of the delegation (new art. 116 Cost) the key to the allocation or maintenance by the individual regions of autonomy in meanwhile abolished, opening up a new prospect of goverment variable geometry.
