"Compliance of collective agreements is one of the most significant issues in our industrial relations system.

From 2011, industrial relations have been challenged to deal with this topic and interconfederal agreements used and implemented the concept of “esigibilità” that has been definitively elaborated by the interconfederal agreement of the 10 January 2014 named “Testo Unico sulla Rappresentanza”.

This paper tries to deepen the topic of “esigibilità” analyzing the issue of compliance of collective agreements on one hand under the general principles of civil law, also for what concerns consequences of possible violation of compliance clauses, on the other hand examining the new provisions introduced by the “Testo Unico”.

The essays composing this e-book are focused on the analysis of the available regulatory instruments that are able to enforce collective agreements provisions paying attention also to the problems descending from the missed implementation of article 40 of Italian Constitution."
