Occupational Health and Safety: a European and Comparative Legal Perspective

This paper will be published as a chapter of the European Compendium on Health Law, M. Buijsen and A. den Exter (eds) Maklu Press Antwerp 2015.
This essay provides an up-to-date juridical analysis of one of the most important field of intervention of EU Labour Law: occupational health and safety. Starting from the definitions of ‘working environment’, ‘health’ and ‘safety’ elaborated by the Court of Justice of the European Union in its case law, which, at its turn, refers to the definition of health provided by the World Health Organisation, the author focuses of the EU Law legal framework, providing a legal analysis of its most important instruments, adding a comparative perspective, which involves 10 out of the most representative European legal systems.
