Gli eterni ritorni: dentro, fuori o oltre l’art. 39 della Costituzione?

The paper takes account of  the possible evolutionary scenario of industrial relations in the light of the democratic principle laid down in Article 39 of the Constitution. The recent Interconfederal Agreements on the Representation may be considered consistent with the constitutional provision. Otherwise, the interventions which tend to deconstruct the contractual system and deprive the national collective agreements of their functions are not coherent with the constitutional system. In conclusion, the author supposes a legislative intervention achieved to extend the erga omnes efficacy of minimum wages introduced by the national collective agreements
