This article analyses the contents and the connections among some recents European regulations, namely the GDPR, the CSRD, the IA Act, the platform work directive.
It indicates the innovations introduced by these regulations on the firms’ obligations to inform workers and their implications on workers rights. The article indicates common aspects and divergences of the actors and contents of the procedures of risk -assessment, and underlines the opportunities and the limits of these procedures. It shows the diversity and the weaknesses of the involvement of workers representatives in the procedures.
Furthermore the innovations of the directives due diligence and platform workers are analysed. The article also underlines the importance of the norms of the latter directive concerning the firm’s obligation for monitoring, human surveillance, revision and justification of IA decisions; and discusses the consequences of the firm’s refusal to give adequate justification on the distribution of the burden of proof.
Finally the author argues for the necessity of coordination initiatives of these norms by the European authorities and of precise transposing of the directives by the Italian legislator.
